Diminished Value: How to Claim After an Accident

Even after a proper repair, an accident record reduces a vehicle’s resale value. Compensation for that drop is claimed as diminished value, and it is a legal right of the not-at-fault (or less-at-fault) party.
Who can claim?
The owner of the vehicle that was not at fault, or whose fault share is low, claims from the at-fault party’s compulsory motor insurer. A fully at-fault driver cannot claim.
How is it calculated?
Vehicle age, mileage, make and model, extent of damage and the nature of the repaired parts. Chassis damage increases diminished value the most.
Documents
- Accident report or police report
- Repair invoice and damage photographs
- Copy of registration and IBAN
- Loss adjuster report, if available
Timing and appeal
The claim is filed in writing with the insurer. If refused, the Insurance Arbitration Commission provides an appeal route. Because limitation periods apply, do not delay the application.
Common mistake
Closing the file after repair without keeping the invoice. Without invoices and photographs, diminished value cannot be calculated.
